Terms and Conditions

ORDER POLICY
Freight prepaid and allowed on orders exceeding $750.00.
A $50.00 handling fee will be added to orders under $750.00. Minimum order $500.00.
Customers wishing to open a direct account with Fougera must commit to and maintain a minimum annual contract sales volume of $50,000. If Customer cannot commit to minimum annual volume, Customer has the option to obtain products through a network of Authorized Distributors.
Customer requests for Special Handling will require written confirmation for the additional charges incurred.
Customer is obligated to inspect deliveries on receipt; any apparent shortage or breakage should be endorsed on carrier's Bill of Lading.
Concealed loss or damage is to be reported within 72 hours after delivery thus affording opportunity for inspection and processing of carrier claim.
All orders should be placed in full case quantities per item.

TERMS
2% 30 DAYS / 31 DAYS NET
Prices effective February 15, 2011. Prices and discounts subject to change without notice.
Overdue accounts past 30 days may be charged interest at the rate of 1.5% per month (18% per annum on the outstanding balance).
Fougera assumes that customers make a good faith effort to maintain inventory on a first in, first out (FIFO) basis.

RETURN GOODS POLICY
Prior authorization from our Customer Service Department is required and may be obtained by calling 1-800-645-9833.
Returns are subject to a restocking/handling fee (25%) for non-expired/mis-ordered product.Returns must be shipped freight prepaid and accompanied by a Fougera authorization form and return products label.
NDC#, Product Name, Quantity, Lot# and Expiration date must be provided for all outdated merchandise.
Fougera reserves the right to destroy or refuse product returned without prior approval.
Fougera reserves the right to disallow claims for credit in excess of 1% of customer's total purchases during a 12- month period.
Credit will be based on net count received at our warehouse sites.
Credit for product will be valued at lowest of invoice price paid at time of purchase.
Customers may not deduct for returns prior to the issuance of a credit memo by Fougera. If such a deduction is taken, an administrative fee of 5% may be assessed.

CLAIMS
Post-audit claims within 1 year prior to the current year/month will be accepted for consideration.
Supporting documentation on all claims is required.
Fougera requires 60 days after receipt of post audit claim to research and validate claims prior to any deductions.
Post audits submitted not meeting these requirements will not be accepted or allowed.

RETURNABLE ITEMS
Customer will receive credit only for merchandise approved for return or destruction under the following conditions:
  • Expired product returned in unopened containers up to one year past expiration date.
  • In dated merchandise acceptable 6 months prior to expiration date.
NON-RETURNABLE ITEMS
  • Products expressly sold on a non-returnable basis.
  • Products that have been opened, partially used, damaged or improperly stored/handled.
  • Requests deemed to be temporary inventory reduction (overstock).
  • Requests made by other than the original purchaser.
  • Outdated returns totaling $100.00 or less.
  • Products involved in a fire sale, sacrifice sale or bankruptcy sale.
  • Products purchased outside of Fougera's normal distribution system.
ADDITIONAL INFORMATION
Fougera will process chargebacks on unit of sale that was purchased and contracted by Customer and/or a third party contract that Customer is servicing. Fougera will deny chargebacks on less than the unit of sale/contract. For information on unit of sale please call customer service at 1-800-645-9833 or visit us at www.fougera.com.
Fougera will not honor any deductions regarding freight charges or handling costs incurred for the return or destruction of product.
Fougera will not be responsible for any administrative fees associated with outside processing companies.
Products purchased from anywhere other than direct from Fougera should be returned to the point of purchase.
Fougera reserves the right to amend this policy by notification to the customer.
